Ðiều 30 Bộ luật Dân sự năm 2015 quy định quyền được khai sinh, khai tử: “2. Cá nhân chết phải được khai tử.”

1. Trình tự, thủ tục khai tử

Trình tự, thủ tục khai tử được thực hiện theo hướng dẫn tại Nghị định 123/2015/NĐ-CP hướng dẫn Luật hộ tịch:

– Thẩm quyền đăng ký khai tử (Điều 32 Luật hộ tịch năm 2014): Ủy ban nhân dân cấp xã nơi cư trú cuối cùng của người chết thực hiện việc đăng ký khai tử. Trường hợp không xác định được nơi cư trú cuối cùng của người chết thì Ủy ban nhân dân cấp xã nơi người đó chết hoặc nơi phát hiện thi thể người chết thực hiện việc đăng ký khai tử.

– Thủ tục (Khoản 2 Điều 4 Nghị định số 123/2015/NĐ-CP): Người có trách nhiệm đi đăng ký khai tử nộp tờ khai theo mẫu quy định và Giấy báo tử hoặc giấy tờ khác thay giấy báo tử cho cơ quan đăng ký hộ tịch. Giấy báo tử phải ghi rõ họ, tên, địa chỉ của người chết; giờ, ngày, tháng, năm chết theo Dương lịch; địa điểm chết và nguyên nhân chết.

Thẩm quyền cấp Giấy báo tử:

a) Đối với người chết tại cơ sở y tế thì Thủ trưởng cơ sở y tế cấp Giấy báo tử;

b) Đối với người chết do thi hành án tử hình thì Chủ tịch Hội đồng thi hành án tử hình cấp giấy xác nhận việc thi hành án tử hình thay Giấy báo tử;

c) Đối với người bị Tòa án tuyên bố là đã chết thì Bản án, quyết định có hiệu lực của Tòa án thay Giấy báo tử;

d) Đối với người chết trên phương tiện giao thông, chết do tai nạn, bị giết, chết đột ngột hoặc chết có nghi vấn thì văn bản xác nhận của cơ quan công an hoặc kết quả giám định của Cơ quan giám định pháp y thay Giấy báo tử;

đ) Đối với người chết không thuộc một trong các trường hợp quy định tại các Điểm a, b, c và d của Khoản này thì Ủy ban nhân dân cấp xã nơi người đó chết có trách nhiệm cấp Giấy báo tử.

Thời hạn đăng ký khai tử (Điều 33 Luật hộ tịch năm 2014): Trong thời hạn 15 ngày kể từ ngày có người chết thì vợ, chồng hoặc con, cha, mẹ hoặc người thân thích khác của người chết có trách nhiệm đi đăng ký khai tử; trường hợp người chết không có người thân thích thì đại diện của cơ quan, tổ chức, cá nhân liên quan có trách nhiệm đi khai tử.

2. Hồ sơ đăng ký khai tử

Các loại giấy tờ phải nộp:

  1. Phiếu cung cấp thông tin đăng ký khai tử (người đi khai tử tự viết hoặc tham khảo mẫu tại UBND xã, phường, thị trấn nơi đăng ký khai tử)
  2. Bản chính Giấy báo tử.
  3. Đối với người chết tại bệnh viện hoặc tại cơ sở y tế thì Giám đốc bệnh viện hoặc người phụ trách cơ sở y tế đó cấp Giấy báo tử.
  4. Đối với người cư trú ở một nơi nhưng chết ở một nơi khác ngoài cơ sở y tế thì Ủy ban nhân dân xã, phường, thị trấn nơi người đó chết cấp Giấy báo tử.
  5. Đối với người chết là quân nhân tại ngũ, công chức quốc phòng, quân nhân dự bị trong thời gian tập trung huấn luyện hoặc kiểm tra tình trạng sẵn sàng chiến đấu, phục vụ chiến đấu và những người được tập trung làm nhiệm vụ quân sự do các đơn vị quân đội trực tiếp quản lý thì thủ trưởng đơn vị đó cấp Giấy báo tử.
  6. Đối với người chết trong trại giam, trại tạm giam, nhà tạm giam hoặc tại nơi tạm giữ thì thủ trưởng cơ quan nơi giam, giữ người đó cấp Giấy báo tử.
  7. Đối với người chết tại trường giáo dưỡng, cơ sở giáo dục do ngành Công an quản lý thì Thủ trưởng các cơ quan đó cấp Giấy báo tử.
  8. Đối với người chết do thi hành án tử hình thì Chủ tịch Hội đồng thi hành án tử hình cấp Giấy báo tử.

Trong trường hợp không có Giấy báo tử thì nộp giấy tờ thay thế sau:

  • Trường hợp một người bị Toà án tuyên bố là đã chết thì quyết định tuyên bố chết của Toà án đã có hiệu lực pháp luật thay cho Giấy báo tử.
  • Trường hợp người chết có nghi vấn thì văn bản xác định nguyên nhân chết của cơ quan công an hoặc của cơ quan y tế cấp huyện trở lên thay cho Giấy báo tử.
  • Đối với người chết trên phương tiện giao thông thì người chỉ huy hoặc điều khiển phương tiện giao thông phải lập biên bản xác nhận việc chết, có chữ ký của ít nhất hai người cùng đi trên phương tiện giao thông đó. Biên bản xác nhận việc chết thay cho Giấy báo tử.
  • Đối với người chết tại nhà, ở nơi cư trú thì văn bản xác nhận việc chết của người làm chứng thay cho Giấy báo tử. Trong trường hợp cán bộ Tư pháp hộ tịch biết rõ về việc chết thì không phải nộp văn bản xác nhận của người làm chứng.

Lưu ý: Trường hợp trẻ em sinh ra sống được từ 24 giờ trở lên rồi mới chết thì cha mẹ phải có nghĩa vụ đi đăng ký khai tử.

Các loại giấy tờ phải xuất trình:

  1. Bản chính giấy chứng minh nhân dân, sổ hộ khẩu, Giấy chứng nhận nhân khẩu tập thể hoặc Giấy đăng ký tạm trú có thời hạn của người chết.
  2. Bản chính chứng minh nhân dân hoặc hộ chiếu của người đi khai tử.

Trường hợp sau 15 ngày kể từ ngày một người chết thì thân nhân chủa người đó phải tiến hành thủ tục khai tử tại UBND cấp xã nơi cư trú cuối cùng của người chết. Quá thời hạn này, khi tiến hành thủ tục khai tử quá hạn cụ thể.

3. Trường hợp đăng ký khai tử quá hạn

Người đi đăng ký khai tử quá hạn phải nộp các giấy tờ sau :

1. Giấy báo tử hoặc giấy tờ thay cho Giấy báo tử.
2. Giấy tờ thay cho Giấy báo tử Đối với người chết tại nhà ở nơi cư trú là “Văn bản xác nhận việc chết của người làm chứng.
3. Đơn đề nghị giải quyết việc đăng ký khai tử quá hạn.
