Nguyên tắc giải quyết tài sản của vợ chồng

Căn cứ theo Điều 33 Luật Hôn nhân và Gia đình năm 2014 quy định về tài sản chung của vợ chồng như sau:

“Điều 33. Tài sản chung của vợ chồng

1. Tài sản chung của vợ chồng gồm tài sản do vợ, chồng tạo ra, thu nhập do lao động, hoạt động sản xuất, kinh doanh, hoa lợi, lợi tức phát sinh từ tài sản riêng và thu nhập hợp pháp khác trong thời kỳ hôn nhân, trừ trường hợp được quy định tại khoản 1 Điều 40 của Luật này; tài sản mà vợ chồng được thừa kế chung hoặc được tặng cho chung và tài sản khác mà vợ chồng thỏa thuận là tài sản chung.
Quyền sử dụng đất mà vợ, chồng có được sau khi kết hôn là tài sản chung của vợ chồng, trừ trường hợp vợ hoặc chồng được thừa kế riêng, được tặng cho riêng hoặc có được thông qua giao dịch bằng tài sản riêng.

2. Tài sản chung của vợ chồng thuộc sở hữu chung hợp nhất, được dùng để bảo đảm nhu cầu của gia đình, thực hiện nghĩa vụ chung của vợ chồng.

3. Trong trường hợp không có căn cứ để chứng minh tài sản mà vợ, chồng đang có tranh chấp là tài sản riêng của mỗi bên thì tài sản đó được coi là tài sản chung.“

Khi xảy ra vấn đề dẫn đến ly hôn, việc giải quyết tài sản của vợ chồng phụ thuộc vào chế độ tài sản mà vợ chồng lựa chọn.

Chế độ tài sản theo thoả thuận: Việc giải quyết tài sản khi ly hôn được áp dụng theo nội dung mà vợ chồng đã thoả thuận. Trường hợp vợ chồng thoả thuận không đầy đủ hoặc không rõ ràng thì Toà án áp dụng quy định tương ứng như chế độ tài sản theo quy định của pháp luật để giải quyết.

Chế độ tài sản theo luật định: Việc giải quyết tài sản do vợ chồng theo thoả thuận. Trong trường hợp vợ chồng không thoả thuận được thì Toà án giải quyết theo yêu cầu của vợ, chồng. Giải quyết tài sản chung của vợ chồng khi ly hôn cần tuân thủ các nguyên tắc theo quy định tại Điều 59 Luật Hôn nhân và gia đình năm 2014, cụ thể như sau:

+ Tài sản chung của vợ chồng được chia đôi nhưng có tính đến:

  • Hoàn cảnh của gia đình và của vợ, chồng;
  • Công sức đóng góp của vợ, chồng vào việc tạo lập, duy trì và phát triển khối tài sản chung. Lao động của vợ, chồng trong gia đình được coi như lao động có thu nhập;
  • Bảo vệ lợi ích chính đáng của mỗi bên trong sản xuất, kinh doanh và nghề nghiệp để các bên có điều kiện tiếp tục lao động tạo thu nhập;
  • Lỗi của mỗi bên trong vi phạm quyền, nghĩa vụ của vợ chồng.

+ Tài sản chung của vợ chồng được chia bằng hiện vật, nếu không chia được bằng hiện vật thì chia theo giá trị. Bên nào nhận phần tài sản bằng hiện vật có giá trị lớn hơn phần mình được hưởng thì phải thanh toán cho bên kia phần chênh lệch.

+ Bảo vệ quyền và lợi ích hợp pháp của vợ, con chưa thành niên, con đã thành niên mất năng lực hành vi dân sự hoặc không có khả năng lao động và không có tài sản để tự nuôi mình.

+ Tài sản riêng của vợ, chồng thuộc quyền sở hữu của người đó, trừ trường hợp tài sản riêng đã nhập vào tài sản chung theo quy định chung.

+ Trong trường hợp không có căn cứ để chứng minh tài sản mà vợ, chồng đang có tranh chấp là tài sản riêng của mỗi bên thì tài sản đó được coi là tài sản chung.

Giải quyết tài sản của vợ chồng trong một số trường hợp:

Chia tài sản trong trường hợp vợ chồng sống chung với gia đình

+ Trong trường hợp vợ chồng sống chung với gia đình, không xác định được tài sản của vợ chồng trong khối tài sản chung của gia đình thì vợ hoặc chồng khi ly hôn được chia một phần trong khối tài sản chung đó căn cứ vào công sức đóng góp của vợ chồng vào việc tạo lập, duy trì, phát triển khối tài sản chung cũng như vào đời sống chung của gia đình. Việc chia một phần trong khối tài sản chung do vợ chồng thỏa thuận với gia đình; nếu không thỏa thuận được thì yêu cầu Tòa án giải quyết.

+ Trong trường hợp vợ chồng sống chung với gia đình mà tài sản của vợ chồng trong khối tài sản chung của gia đình có thể xác định được theo phần thì khi ly hôn, phần tài sản của vợ chồng được trích ra từ khối tài sản chung đó để chia theo quy định.

Chia tài sản là quyền sử dụng đất của vợ chồng khi ly hôn

  1. Đối với đất nông nghiệp trồng cây hàng năm, nuôi trồng thuỷ sản: nếu cả hai bên đều có nhu cầu và điều kiện trực tiếp sử dụng đất thì được chia theo thoả thuận của vợ chồng. Nếu không thoả thuận được thì Toà án áp dụng các nguyên tắc chia tài sản của vợ chồng khi ly hôn để giải quyết. Trong trường hợp chỉ có một bên có nhu cầu và có điều kiện tiếp tục sử dụng đát thì bên đó được tiếp tục sử dụng nhưng phải thanh toán cho bên kia phần giá trị quyền sử dụng đất mà họ được hưởng. Trong trường hợp vợ chồng có quyền sử dụng đất chung với hộ gia đình thì khi ly hôn phần quyền sử dụng đất của vợ chồng được tách ra và chia.
  2. Đối với đất nông nghiệp trồng cây lâu năm, đất lâm nghiệp để trồng rừng, đất ở: Việc giải quyết quyền sử dụng đối với loại đất này khi vợ chồng ly hôn áp dụng các nguyên tắc chia tài sản chung theo quy định tại Điều 59 của Luật Hôn nhân và gia đình năm 2014.
  3. Đối với loại đất khác thì được chia theo quy định của pháp luật đất đai.

Tài sản kể cả quyền sử dụng đất hình thành sau thời kỳ hôn nhân là tài sản chung của vợ chồng. Việc chỉ vợ hoặc chồng đứng tên trên GCN quyền sử dụng đất không phải là căn cứ để xác định quyền sở hữu riêng của vợ hoặc chồng đối với tài sản này. (Theo Điều 33 Luật Hôn nhân và Gia đình năm 2014 nêu trên)

Tuy nhiên khoản 4 Điều 98 Luật Đất đai năm 2013 có hiệu lực từ ngày 01/07/2014 quy định: “Trường hợp quyền sử dụng đất hoặc quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất hoặc quyền sở hữu nhà ở và tài sản khác gắn liền với đất là tài sản chung của vợ và chồng thì phải ghi cả họ, tên vợ và họ, tên chồng vào Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất, trừ trường hợp vợ và chồng có thỏa thuận ghi tên một người.

Trường hợp quyền sử dụng đất hoặc quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất hoặc quyền sở hữu nhà ở và tài sản khác gắn liền với đất là tài sản chung của vợ và chồng mà Giấy chứng nhận đã cấp chỉ ghi họ, tên của vợ hoặc chồng thì được cấp đổi sang Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất để ghi cả họ, tên vợ và họ, tên chồng nếu có yêu cầu”.

Theo quy định này, sau thời điểm Luật Đất đai 2013 có hiệu lực, để một người đứng tên quyền sử dụng đất thì phải có văn bản thỏa thuận của vợ chồng cho vợ hoặc chồng đứng tên. Như vậy, nếu giữa hai vợ chồng có thỏa thuận nhưng không phải thỏa thuận là tài sản riêng thì dù đứng tên một người vẫn được xác định là tài sản chung. Lúc này, nếu thực hiện giao dịch liên quan đến tài sản chung vợ chồng thì phải có sự đồng ý của cả hai vợ chồng.

Như vậy, kể từ khi Luật Đất đai có hiệu lực, cần lưu ý quy định trên để có thể yêu cầu cấp đổi sang Giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất để ghi cả họ, tên vợ và họ, tên chồng.

Chia tài sản chung của vợ chồng đã đưa vào kinh doanh

Khi ly hôn, vợ, chồng đang thực hiện hoạt động kinh doanh liên quan đến tài sản chung của vợ chồng có quyền được nhận tài sản đó và phải thanh toán cho bên kia phần giá trị tài sản mà họ được hưởng, trừ trường hợp pháp luật về kinh doanh có quy định khác (Điều 64 Luật Hôn nhân và gia đình năm 2014).
